1. With MTN Lotto Lidonga Technology and Telecoms brings you various National Lottery products via the internet and cellular technology in accordance with the following terms and conditions, applicable legislation and gaming rules. The legislation and gaming rules are available on http://www.nationallottery.co.za/ which you acknowledge that you have read, understood and accepted before playing any of the available National Lottery products offered by MTN Lotto.
   
   
2. Although Lidonga Technology and Telecoms shall endeavour to provide accurate and up to date information on MTN Lotto neither Lidonga Technology and Telecoms, the National Lottery, the National Lotteries Board nor any of their employees, agents and associates including Lidonga Group of Companies make any representations or give any warranties, whether expressly, tacitly or implied, as to the operation of MTN Lotto, the information, content, materials and products that are included and available on MTN Lotto. Lidonga Technology and Telecoms, the National Lottery, the National Lotteries Board, their employees, agents and associates including Lidonga Group of Companies shall not be liable for any damage of whatsoever nature arising or resulting from the use of or inability to use MTN Lotto or the information contained herein, including but not limited to direct, indirect, incidental, punitive and consequential damages. 3. These Terms and Conditions ("terms and conditions") apply to all National Lottery games played via MTN Lotto. By accepting these terms and conditions, you agree to be bound by these terms and conditions, the Lotteries Act, the Game Rules and the Game Procedures for each individual Game. By using MTN Lotto to participate in the South African National Lottery you are making an offer to purchase entries in the particular Draw or Draws nominated, which offer if accepted will constitute a contract made in South Africa under South African laws.
   
   
4. Before you are eligible to purchase any National Lottery product through MTN Lotto and to qualify for any prizes, you must be at least 18 years of age.
   
   
5. It is your sole responsibility to satisfy yourself prior to confirming the purchase of any National Lottery ticket that all the details shown on the relevant electronic page (Internet or cellphone) are correct.
   
   
6. You must deposit funds into the wallet by the means advised on this Web Site to purchase a lottery ticket. You will only be permitted to purchase lottery tickets once confirmation was received from the relevant financial institution that funds have been successfully transferred to your wallet. You will only be able to purchase a lottery ticket once such a confirmation has been sent to you. You must have enough money in your wallet to complete requested transactions. If you do not, we retain the right to decline any authorisation relating to the transaction.
   
   
7. You are responsible for maintaining the confidentiality of passwords and are fully responsible for all activities that occur under your password. Lidonga Technology and Telecoms cannot and will not be liable for any loss, claim or damage you may suffer or incur arising from and/or as a result of the use (authorised or unauthorised) of your password and/or wallet. You acknowledge that if a third party becomes aware of your password such person will have access to all of the services and features associated with the operation of your wallet, including, the choosing of numbers, transfer of funds, pay-outs and payments in (among others). This includes any members of a syndicate on whose behalf you might act.
   
   
8. Lidonga Technology and Telecoms reserves the right to delete accounts that are inactive for an extended period of time.
   
   
9. A cash handling fee will be clearly stated during the registration process and will be charged on all deposits into your wallet.
   
   
10. Your cellphone number must be used as your reference number when making transfers into the Lidonga bank account. Should your cellphone number change, please contact our call centre on 083 916 1777 to update your details.
    
    
11. Lidonga Technology and Telecoms may suspend or close a Player's wallet at any time without notice and without giving any reason and the balance of such account shall be remitted to the Player unless Lidonga Technology and Telecoms is required to do otherwise by law.
    
    
12. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration process; to maintain and promptly update your information to keep it true, accurate, current and complete, to acquaint yourself and to comply with the relevant lottery game rules and legislation in force from time to time.
    
    
13. Lidonga Technology and Telecoms reserves the right to verify the eligibility of all entrants. Should you provide any information that is untrue, inaccurate, not current or incomplete, or Lidonga Technology and Telecoms suspects that such information is untrue, inaccurate, not current or incomplete, Lidonga Technology and Telecoms has the right to remove and discard any information gathered from you, and refuse any and all current or future use of the service (or any portion thereof). Any player supplying false or misleading information: telephone number, fax, email, box or street address, name, credit card information and everything related but not limited to, will forfeit any prize won through this service without notification.
    
    
14. Personal details provided during the registration process will be kept confidential and will not be disclosed to any third party.
    
    
15. Prize winners at MTN Lotto is deemed to acknowledge that, if and to the extent that Lidonga Technology and Telecoms is legally obliged to provide a third party with details of any Prize claimed by or on behalf of, or paid to the Prize winner, Lidonga Technology and Telecoms shall be entitled to do so.
    
    
16. Lidonga Technology and Telecoms may in its absolute discretion refuse or cancel your registration or refuse to process any further purchases of National Lottery products for any reason whatsoever.
    
    
17. Lidonga Technology and Telecoms reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any of the MTN Lotto services (or any part thereof) with or without notice. Lidonga Technology and Telecoms, the National Lottery, the National Lotteries Board nor any of their employees, agents and associates including Lidonga Group of Companies shall not be liable to you or to any third party for any modification, suspension or discontinuance of the MTN Lotto service.
    
    
18. The following representations and warranties are material to Lidonga Technology and Telecoms and have been relied upon to induce Lidonga Technology and Telecoms to accept your purchase/s:
    
    
    1. You have acquainted, and will continue to acquaint, yourself with the current game rules of the National Lottery product in which you purchase lottery tickets through MTN Lotto;
       
       
    2. You fully comply with the current rules of the National Lottery and the Lotteries Act, 1997;
       
       
    3. You are at least 18 years of age;
       
       
    4. You have the necessary legal capacity to purchase National Lottery tickets and each purchase you make, when accepted, will be legally binding and enforceable against you.
19. You may opt to receive communication via e-mail or via sms. The communication costs are clearly stated during the registration process and these rates are subject to change at the sole discretion of the relevant network service providers. You are responsible for ensuring that we have your correct Cellphone number and e-mail address. Lidonga Technology and Telecoms will not be held responsible if the SMS or e-mail is sent to the wrong number or address if you have not updated your records with us and cannot guarantee the accuracy or arrival of an SMS and/or e-mail. Lidonga Technology and Telecoms are dependent on external service providers to deliver information on account transactions and accept no liability whatsoever, and you indemnify us against any loss, expense, claim or damage whatsoever arising from the use of the Service, or arising from any delay or failure by us to send an e-mail or SMS. Lidonga Technology and Telecoms make no representation or warranty, whether express or implied, as to the operation and functionality of the Service.
    
    
20. Purchasing cut off times are displayed on the How to Play pages and payment for purchases must be completed before the cut off time for the ticket to be valid for the selected draw. You are responsible to ensure that National Lottery ticket purchase are completed on time for a draw.
    
    
21. All fees for the transfer of winnings are for your account. Bank charges applied by your bank pertaining to any purchase made via MTN Lotto will be for your account.
    
    
22. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the MTN Lotto web site or any service provided therein.
    
    
23. The instructions on how to register and use the MTN Lotto service forms part of these terms and conditions.
    
    
24. The failure of Lidonga Technology and Telecoms to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.
    
    
25. Lidonga Technology and Telecoms shall have no liability whatsoever for any breach of these terms and conditions due to any cause beyond its reasonable control including but not limited to: an act of God (including inter alia weather, flood and lightning), technical issues (including inter alia server operation interruption, telecommunication interruption, breakdowns, power failures and other interruptions), fire, industrial action, act or omission of Government, or other competent authority, riot, war or act or omission of any third party for whom Lidonga Technology and Telecoms is not responsible.
    
    
26. If any provision of the terms and conditions is found by a Court of competent jurisdiction to be invalid, the other provisions will remain in full force and effect.
    
    
27. Lidonga Technology and Telecoms reserves the right to alter or amend these terms and conditions without notice at any time, if deemed necessary in their opinion, or if circumstances arise outside of their control. In such an event, all participants agree to waive any rights that they may have in terms of these terms and conditions and acknowledge that they have no recourse against Lidonga Technology and Telecoms, the National Lotteries Board or their employees, agents and partners.
    
    
28. The materials in MTN Lotto are provided "as is" and without warranties of any kind either expressed or implied. Lidonga Technology and Telecoms does not warrant or make any representations regarding the use or the results of the use of the content or other materials in MTN Lotto in terms of their correctness, accuracy, reliability, or otherwise.
    
    
29. To the fullest extent permissible pursuant to applicable law, Lidonga Technology and Telecoms disclaims all warranties, express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. Lidonga Technology and Telecoms does not warrant the accuracy, completeness or usefulness of any information contained on MTN Lotto. Lidonga Technology and Telecoms does not warrant that the functions contained in the materials available on MTN Lotto will be uninterrupted or error-free, that defects will be corrected, or that the materials, MTN Lotto or the server that makes them available are free of viruses or other harmful components. You (and not Lidonga Technology and Telecoms) assume the entire cost of all necessary servicing, repair and correction.
    
    
30. Under no circumstances, including, but not limited to, negligence, shall Lidonga Technology and Telecoms be liable for any special or consequential damages that result from the use of, or the inability to use, MTN Lotto or any downloaded materials, even if Lidonga Technology and Telecoms or its representative has been advised of the possibility of such damages. In no event shall Lidonga Technology and Telecoms's total liability to you from all damages, losses, and causes of action (whether in contract, or otherwise) exceed the amount you paid to Lidonga Technology and Telecoms, if any, for products purchased on MTN Lotto.
    
    
31. You acknowledge and agree that the MTN Lotto web site and the services Lidonga Technology and Telecoms provides and any necessary software used in connection with the provision of such services contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that all trademarks, logo's and content contained in advertisements or information presented to you through MTN Lotto is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Lidonga Technology and Telecoms, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Lidonga Technology and Telecoms's services or the software, in whole or in part.
    
    
32. The National Lottery trademarks, logos and product names are the intellectual property and trademarks of the National Lotteries Board (the "National Lottery Marks"). Without Lidonga Technology and Telecoms's prior permission, you agree not to refer to, copy, display or use in any manner, the National Lottery Marks.
    
    
33. Lidonga Technology and Telecoms, the Lidonga Technology and Telecoms logo, other Lidonga Technology and Telecoms logos and product and service names are the intellectual property and trademarks of Lidonga Technology and Telecoms (the "Lidonga Technology and Telecoms Marks"). Without Lidonga Technology and Telecoms's prior permission, you agree not to refer to, copy, display or use in any manner, the Lidonga Technology and Telecoms Marks.
    
    
34. For the avoidance of doubt, the rest of the content of this web site which includes, but is not limited to, the text, graphics, icons, designs, colours, layout are the intellectual property of Lidonga Technology and Telecoms and its associates. All the intellectual property rights referred to herein are governed by the South African and International Intellectual Property Laws.
    
    
35. In the case of any disputes regarding these terms and conditions, the decision of Lidonga Technology and Telecoms will be final and binding, and no correspondence will be entered into.
